What do I need to know about copyrights?

A copyright gives its owner the right to copy, distribute, publicly display or create derivative works from the original work. A copyright also gives its owner the right to license those rights to others.

Some highlights of copyright law in the United States are as-follows:

• Photographs published after 1922 but before 1978 are protected for 95 years after their publication.
• If the artwork was created but not published before 1978, the copyright is effective for the life its creator plus an additional 70 years.
• All artwork published before 1923 are in the public domain (free use).
• Even if you purchase an image from a photographer or designer, you still need their permission to reproduce the image.

Some important points to remember about copyrights:

• Copyright infringements such as reproducing photos without permission can result in civil and criminal penalties.
• Purchasing a print or digital file from your photographer does not mean you have purchased the copyright.
